These AI Selfie Generator Terms (“AI Terms”) apply to your use of the AI Feature - “Selfie Generator” made available on this page.
- For the purposes herein, “AI Features” means the “Selfie Generator” and any other feature or functionality made available to you on this page that utilizes artificial intelligence models provided by Fiverr International Ltd. (“Fiverr”), through a third-party provider (“Third Party Provider”), all as further set out herein.
- Input and Output Data. You may submit certain data, content or information to the AI Features for processing (“Input Data”) and receive results generated by the AI Features based on the Input (“Output Data”). You hereby represent and warrant that you have all rights, licenses, permissions, power and/or authority required to provide the Input Data to the AI Features. You will be solely responsible for all Input Data and use of the Output Data, including using independent human review to evaluate the accuracy and appropriateness of the Output Data for your use case. You acknowledge that due to the nature of machine learning and the technology powering the AI Features, the Output Data may not be unique to you and that the AI Features may generate the same or similar output for third parties. You acknowledge that you have no right, title or interest in or to any such similar third parties’ outputs or results.
- Third Party Provider. Fiverr engages a Third Party Provider to provide the AI Features. You agree that the Third Party Provider may use the Input and Output Data as necessary to provide the AI Features, comply with applicable laws, and enforce respective policies.
- Use Restrictions. By using the AI Features, you hereby undertake not to directly or indirectly: (a) mislead any person that the Output Data was solely human generated; (b) use the AI Features in a manner which violates or infringes any third party rights or any applicable laws, including but not limited to privacy rights, intellectual property rights, and sanctions and export control laws.
- NO WARRANTIES. FIVERR DISCLAIMS ALL WARRANTIES REGARDING THE AI FEATURES, ITS FUNCTIONALITIES, THE OUTPUT DATA AND/OR THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE AI FEATURES. THE AI FEATURES ARE PROVIDED “AS IS”, “WITH ALL FAULTS” AND ״AS AVAILABLE״, WITHOUT ANY WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, AND FIVERR EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES OR REPRESENTATIONS, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR REPRESENTATIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUALITY, COMPLETENESS, NON-INFRINGEMENT, RELIABILITY, AVAILABILITY AND PERFORMANCE. FIVERR DOES NOT WARRANT OR REPRESENT THAT THE AI FEATURES AND/OR THE OUTPUT DATA WILL BE UNINTERRUPTED, ERROR OR BUG FREE, NON-OFFENSIVE, NON-INFRINGING, NON-HARMFUL ACCURATE, LAWFUL OR APPROPRIATE. YOUR USE OF AND RELIANCE UPON THE AI FEATURES, THE OUTPUT DATA AND/OR ANY RESULTS THEREOF ARE ENTIRELY AT YOUR OWN DISCRETION AND RISK, AND FIVERR HAS NO LIABILITY WHATSOEVER TO YOU IN CONNECTION WITH ANY OF THE FOREGOING.
- Indemnification. you agree to indemnify, defend, and hold Fiverr harmless against any liabilities, damages, and costs (including reasonable attorneys’ fees) arising out of a claim of any third party related to (a) your use of the AI Features in violation of these AI Terms (including policies of Third Party Provider); or (b) your Input Data.
